Acceptance of Terms
By accessing or using our email marketing application (the "Service"), you agree to be bound by these Terms of Service and Anti-Spam Policy. If you disagree with any part of the terms, you may not access the Service.
Eligibility
Users must be at least 16 years old. By using the Service, you represent and warrant that you meet the age requirement.
User Accounts
You are responsible for maintaining the confidentiality of your account and password. You accept responsibility for all activities that occur under your account, and agree not to use the Service for any illegal purpose. Accounts are limited to one per person or entity.
Content Guidelines
You agree not to transmit any unlawful, threatening, libelous, defamatory, obscene, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or violate any law. We reserve the right to remove any content that violates these guidelines.
Anti-Spam Policy
You agree to comply with all applicable anti-spam laws including CAN-SPAM. This requires obtaining explicit consent from recipients before sending emails, including proper identification, a physical address, and an unsubscribe mechanism in every email. Opt-out requests must be honored promptly, within 10 business days. The use of false headers or sending unsolicited bulk emails is strictly prohibited.
International Compliance
If you collect or process data from individuals in the European Union, you agree to comply with the General Data Protection Regulation (GDPR). You are responsible for ensuring your use of the Service complies with all laws and regulations applicable to you.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever.
Deleting Your Account
You may delete your account at any time from your account settings. Deletion takes effect 30 days after you confirm it. During those 30 days your account is restricted — sending stops, your hosted forms stop accepting submissions, and your account becomes read-only — and you may cancel the deletion by signing in at any point before the date shown to you. After that date your data is permanently erased, apart from the limited billing records described in our Privacy Policy, which we are legally required to retain.
Changes to Terms
We reserve the right to modify these terms at any time. For material changes, we will provide at least 30 days' notice before the new terms take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Virginia, USA, without regard to its conflict of law provisions.
